Autrement, les barri\u00e8res impos\u00e9es sur les informations techniques, les logiciels et l\u2019outillage font grimper les factures, r\u00e9duisent les options des consommateurs et nuisent \u00e0 la comp\u00e9titivit\u00e9 d\u2019une industrie qui soutient quelque 491 800 emplois au pays.\u00a0<\/span><\/p>\n<p><b>En p\u00e9ril<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Avec un parc automobile de pr\u00e8s de 29 millions de v\u00e9hicules, le secteur canadien du march\u00e9 secondaire repose sur l\u2019expertise des ateliers de m\u00e9canique et l\u2019efficacit\u00e9 des distributeurs de pi\u00e8ces. Les obstacles \u00e0 la r\u00e9paration \u00e9rig\u00e9s par les constructeurs repr\u00e9sentent une menace directe pour la p\u00e9rennit\u00e9 de l\u2019ensemble de notre industrie.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La l\u00e9gislation f\u00e9d\u00e9rale devrait \u00e9tablir des exigences claires et coh\u00e9rentes pour l\u2019acc\u00e8s aux informations de r\u00e9paration, aux fonctions logicielles (incluant les mises \u00e0 jour et les \u00e9talonnages), aux outils\/interfaces et aux certificats de s\u00e9curit\u00e9 n\u00e9cessaires.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019acc\u00e8s aux informations cruciales pour un entretien ad\u00e9quat est souvent limit\u00e9 par les r\u00e9seaux de concessionnaires. En contr\u00f4lant les fonctions logicielles et les outils sp\u00e9cialis\u00e9s des v\u00e9hicules modernes, les fabricants peuvent freiner les r\u00e9parateurs ind\u00e9pendants et inciter les clients \u00e0 choisir des services de concessionnaires plus co\u00fbteux. Cela repr\u00e9sente une menace r\u00e9elle pour la viabilit\u00e9 du march\u00e9 secondaire, incluant les centres de carrosserie et les fournisseurs de composants.\u00a0<\/span><\/p>\n<p><b>Enjeux logistiques<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Dans un pays aussi vaste que le n\u00f4tre, o\u00f9 le cinqui\u00e8me de la population vit en milieu rural, d\u00e9pendre uniquement des r\u00e9seaux de concessionnaires pose un r\u00e9el probl\u00e8me. C&rsquo;est particuli\u00e8rement vrai pour les automobilistes qui n&rsquo;ont pas les moyens de payer les tarifs \u00e9lev\u00e9s des concessionnaires ou qui habitent loin d&rsquo;un point de service autoris\u00e9. Trop souvent, les propri\u00e9taires d\u00e9couvrent en cours de route que les outils, les logiciels ou les acc\u00e8s de s\u00e9curit\u00e9 requis ne sont offerts que dans un \u00e9tablissement \u00e9loign\u00e9, parfois situ\u00e9 dans une autre ville ou province. Combin\u00e9s \u00e0 l&rsquo;absence d&rsquo;inspections obligatoires dans certaines r\u00e9gions, ces obstacles menacent la sant\u00e9 du march\u00e9 secondaire et laissent sur la route des v\u00e9hicules dont la s\u00e9curit\u00e9 est compromise.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les voitures modernes sont essentiellement des \u00ab ordinateurs sur roues \u00bb. Le contr\u00f4le exerc\u00e9 par les constructeurs sur les logiciels de r\u00e9paration, les fonctionnalit\u00e9s et les outils ou interfaces n\u00e9cessaires (y compris les acc\u00e8s de s\u00e9curit\u00e9) peut cr\u00e9er des barri\u00e8res qui limitent les droits des consommateurs sur les v\u00e9hicules qu\u2019ils poss\u00e8dent.<\/span><\/p>\n<p><b>Un syst\u00e8me fragment\u00e9<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Le gouvernement f\u00e9d\u00e9ral a adopt\u00e9 des lois ayant entra\u00een\u00e9 des am\u00e9liorations ; toutefois, elles ne sont pas all\u00e9es assez loin pour obliger les constructeurs \u00e0 partager les informations de r\u00e9paration essentielles. Les ateliers ind\u00e9pendants pourraient se retrouver incapables d\u2019effectuer des \u00e9talonnages de batterie de base ou des mises \u00e0 jour logicielles sans l\u2019autorisation du constructeur, ce qui r\u00e9duit la concurrence locale et augmente les co\u00fbts pour les Canadiens d\u00e9j\u00e0 aux prises avec la pression du co\u00fbt de la vie.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En r\u00e9sum\u00e9, sans un acc\u00e8s uniforme aux informations de r\u00e9paration, aux fonctions logicielles, aux outils et aux certificats de s\u00e9curit\u00e9, les Canadiens font face \u00e0 des co\u00fbts de r\u00e9paration plus \u00e9lev\u00e9s et \u00e0 des d\u00e9lais inutiles, particuli\u00e8rement \u00e0 l\u2019ext\u00e9rieur des grands centres.<\/span><\/p>\n<p><b>Protection et soutien<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Un cadre national sur le droit \u00e0 la r\u00e9paration prot\u00e9gerait la concurrence, soutiendrait la main-d\u2019\u0153uvre du march\u00e9 secondaire et assurerait l\u2019entretien s\u00e9curitaire des v\u00e9hicules.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pour r\u00e9tablir l&rsquo;\u00e9quit\u00e9, le Canada devrait adopter une loi f\u00e9d\u00e9rale sur le droit \u00e0 la r\u00e9paration automobile qui exige clairement des constructeurs qu\u2019ils soutiennent la r\u00e9paration ind\u00e9pendante s\u00e9curitaire :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Fournir l\u2019acc\u00e8s \u00e0 des informations de r\u00e9paration normalis\u00e9es, incluant les codes d\u2019anomalie et les proc\u00e9dures d\u2019entretien.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Fournir l\u2019acc\u00e8s aux fonctions logicielles n\u00e9cessaires, y compris les \u00e9talonnages et les mises \u00e0 jour, selon des conditions justes et raisonnables.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Fournir l\u2019acc\u00e8s aux outils, interfaces et certificats de s\u00e9curit\u00e9 requis afin que les r\u00e9parations puissent \u00eatre effectu\u00e9es hors du r\u00e9seau des concessionnaires.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Offrir la possibilit\u00e9 d\u2019acheter des manuels d\u2019entretien et des pi\u00e8ces de remplacement sans restrictions indues.<\/span><\/li>\n<\/ul>\n<p><strong>Force et viabilit\u00e9<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Cette approche renforce les droits des consommateurs, accro\u00eet la concurrence et prot\u00e8ge la viabilit\u00e9 \u00e0 long terme du march\u00e9 secondaire de l\u2019automobile au Canada.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les d\u00e9cideurs f\u00e9d\u00e9raux doivent agir d\u00e8s maintenant pour instaurer un cadre national clair sur le droit \u00e0 la r\u00e9paration.
