Le r\u00e8glement mettant en \u0153uvre les dispositions sur le droit \u00e0 la r\u00e9paration de la Loi\u202f21 entre en vigueur le 5\u202foctobre\u202f2025. C\u2019est l\u2019Office de la Protection du Consommateur qui s\u2019assurera de son application. Le droit \u00e0 la r\u00e9paration est une longue r\u00e9clamation du march\u00e9 secondaire automobile qui dit, sommes toutes, que le propri\u00e9taire d\u2019une automobile a le droit de la faire r\u00e9parer dans l\u2019atelier de son choix. Tout \u00e7a est similaire \u00e0 l\u2019enjeu des ordinateurs et t\u00e9l\u00e9phones cellulaires qui doivent \u00eatre retourn\u00e9s au fabricant pour se faire r\u00e9parer. Le fait que le gouvernement du Qu\u00e9bec \u2013 le premier au Canada et un des premiers en Am\u00e9rique du Nord \u2013 reconnaisse ce droit apr\u00e8s plus d\u2019une d\u00e9cennie de lobby est \u00e0 souligner. Il pouvait y avoir des r\u00e9ticences de la part des constructeurs automobiles \u00e0 partager les donn\u00e9es, les processus de r\u00e9paration ou encore d\u2019ouvrir aux ateliers ind\u00e9pendants l\u2019acc\u00e8s aux pi\u00e8ces d\u2019origine<span style=\"text-decoration: line-through;\">s<\/span> et aux outils sp\u00e9cifiques \u00e0 leur marque. Des raisons de s\u00e9curit\u00e9 \u00e9taient \u00e9voqu\u00e9es, mais cet aspect a \u00e9t\u00e9 grandement \u00e9cart\u00e9 dans le r\u00e8glement. Toutefois, \u00ab\u00a0les techniques qui compliquent la r\u00e9paration ou l\u2019entretien sont interdites, sauf si elles sont n\u00e9cessaires pour prot\u00e9ger le consommateur d\u2019un risque s\u00e9rieux, direct et imm\u00e9diat pour la s\u00e9curit\u00e9 physique\u00a0\u00bb, indique un article de la Loi. Cela signifie que l\u2019application de la Loi pr\u00e9cisera si certaines pi\u00e8ces ou informations ne seront disponibles que par le truchement des concessionnaires. Cela demeure une grande victoire pour les ateliers ind\u00e9pendants et pour le travail de l\u2019Association des Industries de l\u2019Automobile du Canada (AIA), qui pousse avec pers\u00e9v\u00e9rance ce dossier depuis plus de dix ans. Si les ateliers ind\u00e9pendants peuvent maintenant avoir un acc\u00e8s complet aux informations et aux \u00e9quipements dont ils ont besoin pour r\u00e9parer les voitures, m\u00eame les plus modernes, ils devront d\u00e9montrer qu\u2019ils sont \u00e0 la hauteur de cette reconnaissance. Les techniciens doivent \u00eatre form\u00e9s aux meilleures pratiques et doivent \u00eatre en mesure de comprendre et d\u2019appliquer les processus d\u2019entretien et de r\u00e9parations \u00e9tablis par le constructeur.
